Ethical Analysis of Employee Medication Testing

In this project, I will carry out an ethical evaluation of companies partaking in random mandatory employee medicine testing within the office. To support my findings, I will refer to both non-consequentialist and consequentialist ideas which will allow me to place forward a non-bias argument both for and against this action. For the purposes of this report my principal emphasis will be on the non- consequential theory with particular mention of Deontology. To support my analysis, I am going to make reference to multiple perspectives such as; politics, monetary and sociological. These tools will allow me to recognize the moral basics of random medicine testing within the task place and also to create a non-biased argument within in my own results as well as expressing my judgment to a qualification.

In relation to a non-consequential theory the results of your action are not the primary emphasis of the honest justification. Instead the focus is exclusively on the impact of the activities carried out and if the actions are deemed to be moral right or wrong.

In relation to drug tests within the work place this step is ethically right. According to the SAFETY, HEALTH AND WELFARE AT THE JOB Action 2005, employers maintain an even of responsibility of the health and protection of their workers. Within this take action it claims that employers have the duty to guarantee the employees are not under the influence of an intoxicant to the extent that he or she is in such a state concerning endanger his / her own safe practices, health or welfare at the job or that of every other person. If this is deemed the truth employers should action drug testing accordingly. In my own opinion random medication testing can be an important part of the ethical working environment to ensure health insurance and safety rules are retained inline and so providing a safe working environment for his or her employees. (Safeness, HEALTH INSURANCE AND WELFARE AT WORK ACT 2005, 2005).

The Deontology theory is the analysis of responsibility and obligations. This theory considers that some acts are right or incorrect independent of these consequences.

In the good will portion of Kant deontology the focus is on the action as opposed to the consequences. By bringing out random drug testing within an organisation, the employer can sanction arbitrary drug testing anytime.

This theory which was later modified by the scholar Immanuel Kant offers significant honest guidance when making a conclusion. Kant thought that morality is a key component whenever a decision has been made. A "moral maxim must be disconnected from the particular physical details bordering its proposition and should be relevant to any logical being. " (sevenpillarsinstitute. org, 2017)

Regarding the arbitrary drug tests within the work place in this instance, despite the action impeding privateness of your company's employees, the company has a duty of good care to provide a safe working environment for their employees and for that reason this action is deemed ethical correct. This can ensure all staff are safe in their office that they will not be consuming any substances which may endanger themselves or their work colleagues.

Deontology theory is focused on the action as opposed to the consequence, when practising this theory, the next questions must be tackled and implemented combined with the actions. The target of the idea is that one action depends upon weather or not the answer to the next questions are ethically appropriate or wrong.

  • What should I do?
  • Why must i get it done? (Ridge, 2017)

The politics perspectives in this situation refer to the statue regulations/ law of the land that are in destination to protect people in order that they are safe and well. That is a guide that companies must obey if they would like to set up in the united states of choice. The theory behind drug screening would be that they used aiming to make a safe work place for both employees and employers. Medicine use is not really a reflection of medicine use in the task place because of your task it's a reflection on drugs in society. A true medicine customer won't leave their medication usage at the door and say I won't do this inside my job they'll do it in any event. (Fay, 2010)

As mentioned previously medication use and drug addiction may refer to prescription drugs also. Lately, the number of deaths and occasions involving prescription drugs has been increasing within this world. don't arrive on some medicine tests because they are legal and approved to a person. More people die from prescription medications than what die from illegal drugs. Per the building blocks of a drug free world, 45% of fatalities are induced by legal drugs whilst 39% of deaths are in accordance with illegal neighborhood drugs. This demonstrates it is not only neighborhood drugs we need to be testing but also all the drugs available. This statistic also steers people from the general stigma associated with medicine addiction and streets drugs. As legal drugs, may be recommended to a person from their doctor. Within this cases this opens many doors for not only indicator to prescribed medication but also to unlawful distribution of the prescribed substances. This I really believe is another reason drug tests in the working place is ethically the right thing to do, not and then support a healthy and safe working environment but also to ensure staff are in a good place and offer help and direction for individuals who are troubled once the condition has been diagnosed. On the other scale of events some people need these types of tablets to function due to personal injury. This should all be looked at when the drug testing has been done. That no negative judgements are created on the staff. Additionally it is important that whenever this is being done that prior to check employee provides full disclosure if nothing already given so that it is expected to fail roughly on.

Sociology perspectives within necessary drug screening in employees comes as a distinct rise in medicine use in present day society. This is down the simple availability of drugs on our life's you can overcome the counter drugs and neighborhood drugs. Because of this many companies are bringing in enforcements at the task place like medicine trials and dismissal for breach of agreements which I believe to be the correct option for companies in the years ahead.

A consequential theory refers to a predicament whereby the consequences of the activities are taking into consideration when an work is determined to be moral right or incorrect. This theory type focuses on actions as opposed to the consequences of these said actions. Once the consequences are assessed and justified it may then be actioned consequently. Consequentialism means that the consequences are believed before an action is set upon.

Whilst briefly evaluating the Utilitarianism model it conveyed that taking into consideration the consequences of random drug testing could cause some negative moral and feedback within the company from employees. That is a result of the action of the random testing invading employee level of privacy whilst hindering the business's fidelity contract with their employees. In my thoughts and opinions drug assessment doesn't invade people's personal privacy it targets the cover of the people from others who may be on drugs or dependent on drugs to help them offer with a certain type of pressure in their life.

Fidelity agreement between staff and employer. It really is about the duty and good beliefs between employee. This is an fundamental term in your agreement that says staff must be faithful and honest it is the fidelity contract that is approximately duty the staff must its employer. In this agreement, it shows that you can be reliable person and what you say you are is what you are. Despite the fact that this contract may be effected and considered void once required drug trials occurs, based on the deontology no consequential theory and my conclusions listed above this is the action which is moral correct.

Conclusion

In this record, I have assessed the ethical characteristics of mandatory medicine testing in the task place and weather it will or shouldn't be carried out. Within my assessment above I have put forward both for an against arguments concerning whether introducing random mandatory drug checks to the work place is ethically right or wrong. Throughout this report my primary concentration was on the honest value of presenting these bank checks in the task place. To aid my conclusions, I centered on the non-consequential theory- Deontology. This theory targets the action rather than the consequences. Even though the consequences make reference to the invasion of worker level of privacy and the breech with their fidelity agreement predicated on my chosen theory this isn't important. In my judgment the action should be integrated to give a safe working environment for employees per regulatory legislation and provide a obligation of care to the people who work within the organisation. Unless they don't really do drugs and leave the challenge at the gate they'll end up taking this into the workplace and conclude bringing an unpredictable working environment for all other employees. The main matter for employers is to make sure that a safe working environment is provided always.
