Chapter 12. Legal status of members of housing cooperatives

Article 124. Provision of a dwelling in the houses of a housing cooperative

1. A citizen or a legal person admitted to the membership of a housing cooperative, on the basis of a decision of the general meeting of members of a housing cooperative (conference), is provided with a dwelling in the houses of a housing cooperative in accordance with the size of the contributed share.

2. Decisions of the general meeting of members of a housing cooperative (conference) are the basis for the introduction into living quarters in the houses of a housing cooperative.

3. The basis for the possession, use, and in the limits of the disposal of the living quarters stipulated by law is membership in the housing cooperative.

Article 125. The right to share a member of a housing cooperative

1. The procedure and conditions for making a share contribution by a member of a housing cooperative are determined by the charter of the housing cooperative.

2. A share may belong to one or more citizens or legal entities.

Article 126. Temporary tenants in a dwelling in the house of a housing cooperative

A member of a housing cooperative and his family members living together with him, by mutual agreement and with prior notification to the management of a housing cooperative, have the right to allow temporary residents to reside in the dwelling place in their use in the manner and under the conditions provided for in Article 80 of this Code .

Article 127. Section of a dwelling in the house of a housing cooperative

1. A section of a dwelling in a house of a housing cooperative between persons entitled to a share is allowed if each of such persons can be allocated an isolated living quarters or there is a technical possibility of reorganization and (or) re-planning of uninsulated premises into isolated dwellings.

2. Disputes about the division of living quarters in the home of a housing cooperative are resolved in court.

Article 128. Renting a dwelling in the house of a housing cooperative

1. A member of a housing cooperative who has not paid a full share contribution, with the consent of the members of his family living together with him and the management of the housing cooperative, has the right to hand over part of the dwelling occupied by him in the house of the housing cooperative, and in case of temporary retirement - all the living quarters in the house of the housing cooperative fee.

2. A housing cooperative, in accordance with the procedure established by the charter of the cooperative, has the right to lease for rent the vacant living quarters that were in the possession of members of the cooperative, released or expelled from the housing cooperative, until new members are admitted to the housing cooperative.

3. Lease of a dwelling in the house of a housing cooperative is carried out according to the rules stipulated in articles 76 - 79 of this Code.

Article 129. The right of ownership of a dwelling in an apartment building of a member of a housing cooperative

1. A member of a housing cooperative acquires ownership of a dwelling in an apartment building in the event of payment of a share contribution in full.

2. On property relations in an apartment building in a housing cooperative, subject to the fully paid share, at least one member of the housing cooperative is subject to the effect of Chapter 6 of this Code.

Article 130. Termination of membership in a housing cooperative

1. Membership in a housing cooperative is terminated in the event of:

1) the exit of a member of the cooperative;

2) the exclusion of a member of the cooperative;

3) liquidation of a legal entity that is a member of the cooperative;

4) liquidation of a housing cooperative;

5) death of a citizen who is a member of a housing cooperative.

2. The application of a member of a housing cooperative to voluntarily withdraw from a housing cooperative is considered in accordance with the procedure provided for by the charter of the housing cooperative.

3. A member of a housing cooperative may be expelled from a housing cooperative on the basis of a decision of the general meeting of members of a housing cooperative (conference) in the event of gross negligence by that member of its duties, established by this Code or the charter of a housing cooperative, without good reason.

4. In the event of the death of a member of a housing cooperative, its heirs are entitled to become members of this housing cooperative by decision of the general meeting of members of the housing cooperative (conference).
