System of posts in the civil service, their categories, groups and registries

Federal law No. 58-FZ and No. 79-FZ established a fundamentally different classification of civil service positions than before.

In accordance with Art. 9 of the Federal Law No. 79-FZ of the civil service of the federal and subject levels are divided into the following categories .

1. Executives - positions of heads and deputy heads of state bodies and their structural units (hereinafter also referred to as the subdivision), positions of heads and deputy heads of territorial bodies of federal executive bodies and their structural divisions, posts of heads and deputy heads of state bodies and their structural units, replaced for a certain term of office or without limitation of term of office.

The selection of the managers the qualifying attribute of the job hierarchy in the state body (structural subdivision) is laid.

2. Assistants (advisers) - positions established to assist persons who replace public offices, heads of state bodies, heads of territorial bodies of federal executive bodies and heads of representative offices of state bodies in the exercise of their powers and replaced for a certain period, limited term of office of the said persons or managers.

The appointment of this category of civil service positions is performed by persons who occupy them with the functions for the purpose of directly ensuring the exercise of the powers of a person who is in a public office or managerial position. In a generalized form, these functions can be represented in the following form:

- development and submission of proposals on the relevant areas of the relevant field of activity;

- systematic information and advice, presentation of relevant information and analysis materials;

- participation in the preparation of draft decisions, study of issues requiring professional knowledge;

3. Specialists - positions established for the professional provision of state bodies with established tasks and functions and replaced without restriction of authority.

The main classification feature for the Experts refers to the quality of the activity, namely - to "professional provision of performance by state bodies of established tasks and functions". The peculiarity of this category of civil service positions is that although their unified names are stipulated in the Register of Positions of the Federal Civil Service approved by the Decree of the President of the United States of December 31, 2005 No. 1574, they are established and liquidated by state bodies themselves, as well as they are included in the staff schedules. Their appointment is diverse and depends on the nature of the powers that determine the role of a particular position of the civil service in the implementation of the competence of this government body.

Posts experts and providing specialists constitute the most massive and most stable in composition group in the system of the state civil service. Posts experts and providing specialists Are positions of professional civil service. In essence, these are administrative posts that are replaced without any time limit, in the order of appointment based on the results of the competition. To replace such a post, there is no compulsory need to have a civil service experience.

4. Providing specialists - posts established for organizational, informational, documentary, financial, economic, economic and other support of the activities of state bodies and replaced without restriction of term of office.

For the job category, providing specialists The main classification feature is the type of activity of the state body. The tag that is introduced to allocate posts to the category of "professionals", namely, "professional provision of performance by government bodies of established tasks and functions and replaced without restriction of term of office", is equally applicable to posts in the category "providing specialists".

The establishment of the four new categories of posts allows for more detailed elaboration of requirements for them, clarifying job duties, wages and social guarantees.

The legislator subdivides all posts of the civil service into five groups : junior, senior, leading, main and higher.

However, not all categories of civil service positions have five "steps". So, in the category of posts providing specialists There are only four groups: main, leading, senior and junior groups of civil service positions. The same is true of the category of posts "specialists", which is divided into the highest, leading, leading and senior groups of civil service positions. In this category there is no group of junior civil service positions. As for the posts of categories managers and "assistants (advisers)", then in these categories there are no groups of not only junior, but also senior civil service positions. In these categories, the posts are divided into the highest, leading and leading groups of civil service positions.

The civil service position must be included in the register.

There are two types of registers: the register of civil service positions of the United States and the registers of civil service positions of US subjects. The characteristic features of these registers are defined in Art. 10 of the Federal Law No. 79-FZ.

The register of posts of the federal civil service is approved by a decree of the US President, and the register of civil service positions of US subjects by law or other normative legal act of the subject of the United States.

For effective civil service organization, it is important that the list of posts meet a number of requirements. First, the structure of the register should reflect the classification features of the civil service positions adopted in the existing laws on public service. Secondly, the register is designed to ensure the optimal ratio between posts by types and levels of civil service, categories and groups. Thirdly, the register is the basis for the formation of registers of civil servants. Fourth, the names of posts should be as small as possible in quantity, and they should be, if possible, unified.

The register of positions of the federal civil service ensures the ordering and unification of posts in the civil service system. It is a written list of titles of posts divided by government bodies, categories and groups, as well as other characteristics.

The register of posts of the federal civil service and the registers of posts of the civil service of the United States entities form the Consolidated Register of Civil Service Positions, whose procedure is approved by the President of the United States.

In the Register of Positions of the Federal State Civil Service, the digital codification of civil service positions has been adopted. The lists of posts classified by government bodies are the relevant sections of this Register. The aforementioned Decree of the President of the United States of December 31, 2005 No. 574 in and. 6 it is established that in the registration number (code) of the position of the federal civil service in the Register, the first and second digits correspond to the ordinal number of the section of the Register, the third figure - the categories of the post (supervisors - 1, assistants (advisers) - 2, specialists - 3, 4), the fourth digit - the group of posts (the highest number - 1, the main one - 2, the leading one - 3, the senior one - 4, the youngest - 5), the fifth, sixth and seventh figures - the ordinal number of the position in the section of the Register.

Thus, the above-mentioned Register attaches to the most diverse authorities and their employees (in the apparatus of the State Duma, the Accounts Chamber of the United States, diplomatic missions and other state authorities) strict serial numbers. The apparatus and other public authorities now consist of civil servants with a clearly guaranteed set of rights.

The approval of registries at the federal and US levels has created a legal basis for ensuring the orderliness and compatibility of posts in these levels of civil service.

Normative legal acts on the civil service established that in the United States there can be no civil service positions of other names than those provided for in the register.
