Translation of an employee of law enforcement agencies

The transfer of an employee of the internal affairs bodies may be carried out at a higher, equal or lower position in the internal affairs bodies, in another locality or in connection with his enrollment in the educational organization of higher education of the federal executive body in the field of internal affairs. Translation is allowed with the consent of the employee, expressed in writing. A post in the internal affairs bodies is deemed to be superior if a higher special rank is assigned to it than a special title for the previous position in the internal affairs bodies, and when the special ranks are equal, a higher salary is required.

It should be emphasized that the transfer of an employee of the internal affairs bodies to a higher rank of rank-and-file, junior, middle or senior command staff is carried out based on the results of attestation and/or competition, except for cases when the appointment of an employee to a higher position in the internal affairs bodies is carried out from the staff reserve in which he was a member.

A position in the internal affairs bodies is considered to be equivalent, if it has a special rank and official salary equal to the special rank and salary according to the previous position in the internal affairs bodies. The transfer of an employee of the internal affairs bodies to an equivalent position in the internal affairs bodies is carried out:

a) due to the need to replace another post for the benefit of the service or in rotation

b) for health reasons in accordance with the conclusion of the military medical commission;

c) for personal or family reasons;

d) due to the reduction of the position replaced by the employee;

e) in connection with the reinstatement of an employee in a position he replaced earlier, in case this position is replaced by another employee;

e) in connection with the termination of the fixed-term contract;

g) in connection with the termination of the necessary for the performance of official duties of access to information constituting a state and other secret protected by law;

h) in order to eliminate circumstances related to direct subordination or control of employees who are in a relationship of close kinship or property.

A position in the internal affairs bodies is considered subordinate, if it is provided with a lower special rank than a special title for the former position in the internal affairs bodies, and with equal titles, a lower official salary. The transfer of an employee of the internal affairs bodies to a lower position in the internal affairs bodies is carried out:

a) for health reasons in accordance with the conclusion of the military medical commission;

b) for personal or family reasons;

c) due to the reduction of the position replaced by the employee;

d) in the order of imposition of disciplinary punishment;

e) in connection with the reinstatement of an employee in a position he replaced earlier, in case this position is replaced by another employee and there is no equivalent post;

e) in connection with the termination of the necessary for the performance of official duties of access to information constituting a state and other secret protected by law;

g) in connection with the refusal to transfer to an equivalent position in rotation order

h) in connection with the discrepancy of the employee of the replaced position (taking into account the recommendation of the attestation commission);

i) in order to eliminate circumstances related to direct subordination or control of employees who are in a close relationship or property, in accordance with US law.
